Requirements to Construct a Fence on Your Summit Property

Fence2

Are you planning to have your yard in Summit fenced, or to install a fence on a particular part of your property? If so, you will need to ensure that you comply with the municipal code and all requirements for constructing and installing any “fence, wall or wall-like structure, including shrubs, hedges and the like, located on or within the boundary lines of any lot or parcel of land within the limits of the City of Summit.” In addition to obtaining a construction permit, you will also need a zoning permit that will need to be approved by the Zoning Board, and you will need to comply with the general design requirements set forth in the municipal code. What do you need to know in general about the requirements to construct a fence or something similar on your property?

Consider the following general information about constructing or installing a fence or related structure on your property, and be sure to get in touch with one of the experienced Summit zoning lawyers at Dempsey, Dempsey & Sheehan to discuss your specific plans and needs, and to find out more about how we can help you with the necessary applications and the process of going before the Zoning Board.

Purpose of Fence, Walls, and Wall-Like Structure Requirements

The municipal code states that the requirements for constructing or installing a fence or related structure are “designed to prevent the construction of such fences, walls and wall-like structures in such a manner as to constitute a nuisance or restrict visibility through or across such lands at locations where such visibility is necessary for the safe operation of vehicles passing, entering or leaving any lot or parcel of land located on a public thoroughfare.”

Permit and Design Requirements

There are many permit and design requirements, and general regulations, that must be followed in Summit when a property owner is constructing or installing a fence, wall, or wall-like structure. Both a zoning permit and a construction permit are required, and it is important to discuss the need for variance with your land use lawyer, as well.

Fence, wall, and wall-like structures then must comply with maximum height and location requirements (including a maximum height of seven feet), specific regulations for where a fence can and cannot be placed on the property, specific regulations for swimming pool fences and hedges and landscaping or other plant life, and requirements for maintenance of any of these structures (and particularly the cutting and maintenance of any brush, shrubbery, or other plant life).
